PACT Act Form

On December 27, 2020, Congress amended the Prevent All Cigarette Trafficking (“PACT”) Act to apply to e-cigarettes and all vaping products. The PACT Act, among other things, prohibits the use of the U.S. Postal Service (“USPS”) to deliver cigarettes and smokeless tobacco products directly to consumers.

The PACT Act law goes into effect on March 27th. Devine Distribution is being proactive to avoid delays receiving products.

USPS, UPS, and Fed-Ex will have the following mandatory requirements. Shipments may go only to businesses that have the following current information on file.

  1. Business License (State, County or City issued business license with your company name and shipping address for each location we will be selling and shipping to)
  2. Tobacco License (State Issued Tobacco License for each location we will be selling and shipping to)
  3. FEIN# (Federal Employer Identification Number)

Devine Distribution will be requiring you to have these items on file and freight companies will require an adult (over 21) signature. Tobacco licenses are usually inexpensive and typically easy to get in most states. If your state does not require a tobacco license or is a non excise tax state, your business license is all you would need to send.
